The Civil Liabilities Act along with the associated legislation to raise the small claims limit to £5,000 will result in most personal injury claims being dealt with in the Small Claims Track. In the Small Claims Track solicitors’ fees are not recoverable so it will no longer be possible to fund PI claims handling and generate income streams through solicitor’s recovery of legal fees.
